Pastoral Counselor’s Declarations of First, Fourth, Sixth and Ninth Amendment Constitutional Rights and of Pastoral Counseling Authorization Agreement and Informed Consent

I, Losang Jinpa, D.Ayur, Ph.D in Buddhist Ayurveda, formally and publicly declare and claim my First, Fourth, Sixth and Ninth Amendment Constitutional Rights and the Rights conferred by Article I, Section X of the U.S. Constitution.

I, Losang Jinpa, D.Ayur, declare that the ancient Yogic Buddhist Healing Arts of India, Tibet, Nepal and China (which include Ayurveda, Tibetan Medicine and Traditional Chinese Medicine), offer health education (pastoral counseling) to modern civilization to keep the proper balance between body, mind and consciousness (spirit). Through proper lifestyle, diet, cleansing regimes, and rejuvenation programs the Ayurvedic Healing Arts have traditionally helped one establish a long, healthy, fruitful and spiritual life. These healing arts were first described in the Sanskrit, Tibetan and Chinese languages in the ancient Hindu, Buddhist, Yogic, Vedic  and Taoist scriptures and their commentaries such as the Yoga Sutras of Patanjali, Tibetan Ambrosia Heart Tantra, Huang Di Nei Jing Yellow Emperor's Classic, and Charak, Sushrut, Vagbhat and others. I declare that the Ayurvedic, Tibetan and Chinese Healing Arts, although recently introduced to the United States, have been practiced by both monastic and lay practitioners in India and China for 2500+ years (since the time of Shakyamuni Buddha), and in Nepal and Tibet for 1400+ years (since the arrival of Yogic Buddhism in these countries). It is, however, not presently recognized by the medical establishment of this country.

I declare that I am an Ayurvedic Pastoral Counselor and Ayurvedic Practitioner (duly ordained Minister) and Master Herbalist (Indian, Tibetan, Chinese and Western herb specialist), commissioned by the California-based non-profit 501(c)3 church, called the Medicine Buddha Healing Center (www.Ayurveda-Berkeley.com - also know as the “Ayurveda Healer Arts Institute of California”) and by the New Mexico-based non-profit 501(c)3 Buddhist church, called the Medicine Buddha Healing Center.  You realize that I am not a Doctor and am not advertising myself to be a doctor or medical practitioner and acknowledge that Buddhist Ayurveda is not licensed by the State of California nor can it ever be since it is a constitutionally protected religious practice. So please do not refer to me as "Doctor".

I declare that I complete a six-year apprenticeship with world-renowned author and Ayurvedic Physician, Dr. Vasant Lad, B.A.M.S., M.A.Sc., for more than 1800 hours since 1996 and that I served on the faculty as Herbology Instructor at Dr. Lad’s Ayurvedic Institute (www.ayurveda.com).  I acknowledge that in 2000, I was one of the first Ayurvedic Herbalists ever to be awarded Diplomate of Ayurveda (D.Ayur) by the American Ayurvedic Association (ayurvedicassociation.com). 

Additionally, I declare that in 1996, 1997 and 1998 at Mount Madonna Center (www.mountmadonna.org) in the Santa Cruz Mountains of California I personally observed my Ayurvedic teacher Dr. Lad healing over 275 clients using Indian and Western herbs.  I declare that, as part of 1998 class of the Ayurvedic Institute’s Ayurvedic Studies Program I completed for than 250 hours of classroom study with Dr. Lad in 1998-1999.  I declare that since finishing the Ayurvedic Studied Program in 1999 I continued advanced “Gurukula” clinical study in India and New Mexico, where I have observed my Ayurvedic teacher Dr. Lad healing over 1900 clients in the India and New Mexico using Indian and Western herbs, Ayurvedic acupressure, Pancha Karma cleansing techniques. 

Furthermore, I declare that in addition to my 1800 hours of classroom study with Dr. Lad, I completed an additional 1080 hours of classroom study in Sanskrit (with Dr. Will Foster, D.O.M. and Barbara Cook), Mandarin Chinese, Ayurvedic Yoga (with AyurYoga teacher's Betheyla and Ann Harrison), Western Herbs (with Kevin Spelman), Ayurvedic Acupressure (Donald Van Howten, LMT and Jaisri Lambert, RPP), Ayurvedic Ancient Texts and other theory (with Mike Dick, MA), Chinese Medicine, Tibetan Medicine (Dr. Kelsang Dorjee, B.T.M.S.), Western medical terms, and Anatomy and Physiology.   These additional 1080 hours included more advanced Ayurveda seminar study with Dr. Sunil Joshi, M.D. Ayur, Dr. Robert Svoboda, B.A.M.S., Dr. David Frawley, O.M.D., Bri Maya Tiwari, and others. 

This comes to 2980 hours of study in Asian Healing Arts and the ancient languages from which they arose -- 1800 hours with Dr. Lad and 1080 hours with other teachers.  If this six years of scholarship were in a degree granting college setting (there is currently no seriously accredited college degrees offered in the USA in Ayurvedic Medicine), this would be equal to more than 198 semester units of study.  A typical Bachelor's Degree is equal to 120 semester units (1800 hours of study).  A typical Masters of Science in Traditional Chinese Medicine is equal to 2970 hours of study during a four academic year program (eg. www.ACCHS.edu or www.IICM.org).  

I desire to teach and share with you the Ayurvedic Healing Arts (both Indian and Tibetan) and the Chinese Healing Arts dharmic and karmic principles, tenets and practices and I encourage you to coordinate them with your conventional health care. I declare that you should consult regularly with your usual doctor or primary care provider and do all things necessary to insure your continued good health. I declare that my gentle means of Ayurvedic Healing Arts and your willingly receiving these services is “the practice of religious tenets of a church (Medicine Buddha Healing Center and Medicine Buddha Healing Center) in the ministration to the sick or suffering by mental or spiritual means as provided by the law”).

You and I agree that these services are provided for a sliding scale suggested donation as religious practices and tenets of the Medicine Buddha Healing Center and/or the Medicine Buddha Healing Center and hence they are constitutionally protected under the First, Fourth, Sixth and Ninth Amendments of the United States Constitution. (1st Amendment: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof, or abridging the freedom of speech…”).

You and I agree to allow a digital audio recording (.WMA) to be made of the Buddhist Ayurveda consultation.  You and I agree to allow my in-person apprentices and distance learning (virtual) apprentices to "sit in on" the consultation via the audio recording.  You and I agree to allow all of the information on the Buddhist Ayurveda questionnaire that you will be asked to fill out to be put into a public (on the Internet (www.Ayurveda-California.com) educational anonymous database and Ayurveda Correspondence Course (Distance Learning) with your name, address, e-mail and phone number removed.  You and I agree to have a picture taken of your face, your hands, your tongue and your ears. You and I agree to allow the picture of your tongue, hands and ears along with the authorized digital audio recording (.WMA file) will be included in both database and the Correspondence Course. You and I agree to that the picture of your face will remain confidential and not shared with others without your express written permission. You and I agree to allow this database and Ayurvedic Correspondence Course (along with photos, audios, and questionnaire) to be used for non-profit educational, research and religious purposes, to spread the dharmic teachings of these ancient spiritual healing arts by looking at their modern day manifestations. You and I agree that you are not entitled to any compensation for this recording, photo or questionnaire to be used in the database and Ayurvedic Distance Learning Course.  By filling out the Buddhist Ayurveda questionnaire you agree to these terms and consent to freely provide the information on that form, to have your consultation digitally recorded, and to have your photo taken -- all of which are required for pastoral counseling and is an integral part of ancient Buddhist religious tenets and practices described in various scriptures and their commentaries.



ARTICLE IX, U.S. CONSTITUTION
“The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage other rights retained by the People.” Under the Ninth Amendment to the Constitution of the United States, we both retain the right to freedom of choice in health lifestyle education services and to pastoral counseling (as defined above). This includes the right to choose our diet, and to obtain, purchase and use any therapy, regimen, modality, remedy or product suggested by a therapist, doctor or any other practitioner, educator, or Pastoral Counselor of our choice. The enumeration in this Declaration of these rights shall not be construed to deny or disparage other rights retained by us, or our right to amend this Declaration at any time.
